MEDITERRANEAN DEVEL UP SOLUTIONS SL. es la compañía titular y responsable del desarrollo de la aplicación 4Life Connect 2023 para móviles (en adelante, la “App”).

4Life Connect 2023 pone la App a disposición de los usuarios registrados para que estos puedan utilizar sus servicios, así como ponerse en contacto con el evento si lo necesitan.

2. ÁMBITO DE APLICACIÓN DE LAS CONDICIONES DE USO. ACEPTACIÓN DE LAS CONDICIONES GENERALES.

La descarga y uso de la App atribuye la condición de Usuario de la misma (en adelante, el “Usuario”) e implica la aceptación plena, sin reservas y en su totalidad de los presentes términos y condiciones de uso de la App (en adelante, las “Condiciones Generales”). Por ello, 4Life Connect 2023 recomienda a los Usuarios leer detenidamente las presentes Condiciones Generales antes de utilizar la App.

Las presentes Condiciones Generales regulan junto con la Política de Privacidad el uso de la App por parte del Usuario y la relación entre este último y 4Life Connect 2023. Las Condiciones Generales han sido redactadas de conformidad con lo dispuesto en la normativa vigente aplicable en materia de Internet, comercio electrónico y protección de datos, entre otras.

El acceso y descarga de la App son totalmente gratuitos salvo en lo relativo al coste de la conexión a través de la red de telecomunicaciones suministrada por el proveedor de acceso contratado por el Usuario.

3. DESCARGA Y ACCESO A LA APP.

La descarga de la App es totalmente gratuita y se podrá realizar a través de Apple Store o Google Play, dependiendo del sistema operativo empleado por dispositivo móvil desde el que el Usuario se descargue la App. Para acceder y usar la App es necesario que el Usuario se registre.

Al descargarse la App, el Usuario declara que es mayor de edad y dispone de la capacidad legal necesaria para aceptar las presentes Condiciones Generales.

4. UTILIZACIÓN DE LA APP POR EL USUARIO.

El Usuario deberá ser mayor de edad para descargarse la App y deberá usar la App y sus contenidos conforme a las presentes Condiciones Generales, la buena fe y la legislación vigente aplicable.

El Usuario será el único responsable frente a 4Life Connect 2023 y/o terceros del uso que realice de la App y/o de sus contenidos. En ningún caso y bajo ningún concepto asumirá 4Life Connect 2023 responsabilidad alguna derivada del uso de la App que realice el Usuario, especialmente en los casos en que dicho uso se realice incumpliendo lo dispuesto en las presentes Condiciones Generales y/o la normativa vigente aplicable.

Queda asimismo expresamente prohibido cualquier uso fraudulento abusivo, ilícito o contrario a la buena fe de la App y/o sus contenidos. En consecuencia y sin carácter limitativo el Usuario deberá abstenerse de:

• Reproducir, distribuir, comunicar públicamente, transformar o modificar la App o cualquiera de sus contenidos, incluidas las presentes Condiciones Generales, independientemente del fin de dicho uso, sin autorización previa y por escrito de 4Life Connect 2023.
• Realizar cualquier tipo de actividad ilícita, fraudulenta, contraria a las presentes Condiciones, la legislación vigente y/o la buena fe o que impida y/o dificulte la correcta utilización de la App o sus contenidos.
• Vincular o reproducir la App o sus contenidos desde webs, plataformas, foros, chats, blogs o redes sociales ajenas que sean contrarias a la ley, ofensivas o atentatorias contra la dignidad humana, los derechos fundamentales o la propia Empresa y/o sean susceptibles de ser consideradas como delictivas.
• Introducir y/o difundir en la App contenidos que atenten contra los derechos humanos y la dignidad de las personas como por ejemplo contenido racista, xenófobo, pornográfico o que supongan apología del terrorismo.

5. RÉGIMEN DE RESPONSABILIDAD Y GARANTÍAS.

4Life Connect 2023 no garantiza la disponibilidad en todo momento del acceso y continuidad del funcionamiento de la App. Por ello, 4Life Connect 2023 no responderá de los daños y perjuicios causados al Usuario que se deriven como consecuencia de la indisponibilidad, fallos de acceso y falta de continuidad de la App.

Aunque la App incorpora las salvaguardas adecuadas para protegerla y utiliza la tecnología estándar del sector para mantener y mejorar su seguridad e integridad y la de la información que contiene, Internet no es un medio inexpugnable.

En todo caso es responsabilidad del Usuario proteger su dispositivo móvil frente a posibles virus, malware, ataques de terceros o cualquier otro elemento informático dañino que pudiera afectar a su dispositivo móvil, habilitando para ello herramientas adecuadas para la detección y desinfección de programas informáticos dañinos.

4Life Connect 2023 se esfuerza por ofrecer siempre a los Usuarios en la App información actualizada, completa y exacta. Sin embargo, no toda la información ofrecida en la App es responsabilidad de 4Life Connect 2023 como, por ejemplo, los datos de servicios específicos distribuidos por terceros (vuelos, reservas de hotel). Por ello, 4Life Connect 2023 no puede garantizar siempre y en todo momento la exactitud de la información contenida en la App.

El Usuario responderá ante 4Life Connect 2023 y/o cualquier tercero de cualquier daño y/o perjuicio causado a la Empresa o a terceros derivado directa o indirectamente de cualquier uso que haga de la App y/o de su contenido contraviniendo lo dispuesto en las presentes Condiciones Generales, la legislación vigente aplicable, el orden público y/o la buena fe.

6. DERECHOS DE PROPIEDAD INTELECTUAL E INDUSTRIAL.

La App y todo su contenido (texto, software, gráficos, etc.) son objeto de protección en aplicación de la normativa vigente en materia de Propiedad Intelectual y/o Industrial. 4Life Connect 2023 es la titular o tiene debidamente licenciados todos los derechos de Propiedad Intelectual e Industrial sobre la App y sus contenidos.

Queda prohibida cualquier forma de reproducción, distribución, comunicación pública, transformación, puesta a disposición y, en general, cualquier otro uso y/o acto de explotación de la App y/o de sus contenidos, tenga o no fines comerciales, sin el previo consentimiento previo y expreso de 4Life Connect 2023. Al descargarse la App, 4Life Connect 2023 concede al Usuario una licencia temporal no exclusiva de uso de la App y sus contenidos personal e intransferible con la única finalidad de que el Usuario pueda usar la App y sus contenidos en los términos y condiciones contenidos en las presentes Condiciones Generales.

4Life Connect 2023 se reserva todos los derechos de Propiedad Intelectual e Industrial sobre la App y sus contenidos. En ningún caso y bajo ningún concepto la descarga y/o acceso constituyen o suponen una cesión de ningún tipo por parte de la Empresa de los derechos de Propiedad Intelectual o Industrial de la App o sus contenidos.

7. DURACIÓN Y MODIFICACIÓN

Las presentes Condiciones Generales estarán vigentes durante el tiempo que estén expuestas a los Usuarios, de manera que en cuanto sean modificadas o actualizadas total o parcialmente, las presentes condiciones dejarán de estar vigentes, siendo las nuevas condiciones de uso las que pasen a regular el uso de la aplicación.

4Life Connect 2023 se reserva la facultad de revisar, modificar o actualizar en cualquier momento las presentes Condiciones Generales, en cuyo caso informará debidamente a los Usuarios de dicho cambio con el fin de que puedan aceptar los nuevos términos y condiciones.

8. FUERO Y LEY APLICABLE

Las presentes Condiciones están sometidas a la legislación española. Las partes se someten, a su elección, para la resolución de los conflictos y con renuncia a cualquier otro fuero, a los juzgados y tribunales del domicilio del Usuario.
